Building Sustainability Requirements in NY

What You Need To Know

The Climate Mobilization Act of 2019 is NYC's ambitious climate solution. Under the CMA, there are laws that align with NYC's goals to reduce carbon emissions. Local Law 97 & 154 are two of these laws that will drastically affect new and existing buildings throughout NYC starting in 2024.

Boilers

FAQS

1. What if I file a permit for my new building before the deadline?

You can use gas for the building, but with LL97, there will still be major restrictions, and you will eventually have to upgrade to electric when you renovate.​​

2. How can the grid handle this? (LL154)​

Building electrification poses no immediate risk to the grid. The grid is used to maintaining consistency throughout the summer when electricity usage is the highest, so in the winter when energy use for boilers is the highest, the grid will be able to handle it.​

3. What if I do not comply with the emissions limits?

There are non-compliance fines that can be up to the difference between a building’s annual emissions limit and its actual emissions multiplied by $268.

4. Are there alternative ways to comply?

Alternative ways to meet compliance include purchasing renewable energy credits or certificates (RECs) generated in New York City or directly contributed to the city grid. You can also purchase carbon offsets, or participate in carbon trading by purchasing carbon from buildings that are below their carbon caps. After all alternative options have been implemented and a study has been conducted showing all their potential ways to reduce, the DOB may grant exceptions.

It’s good for the environment! You would be part of a group effort to reduce GHG emissions. This movement may push other cities to regulate their buildings.

Starting now gives you time to budget and prepare so that you are not stuck with penalties/fines.​

It is cheaper to upgrade your boiler systems to compliance standards than to get hit with fees.
